TEDEE NEWSLETTER

  1.  INTRODUCTION
    • These Regulations (“Regulations”) define the terms and conditions of provision of the Tedee Newsletter service to subscribers by Tedee Spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, ul. Karola Bohdanowicza 21/57, entered into the register of entrepreneurs of the National Court Register under number 0000712451, whose registration files are stored by the District Court for the city of Warsaw, XII Economic Division of the National Court Register.st. Warsaw in Warsaw, XII Economic Division of the National Court Register, NIP 7010795542, REGON: 369188621, e-mail: [email protected], telephone number: (+48) 22 307 72 67 (hereinafter: “Service Provider” or “Tedee”).
    • The Tedee Newsletter service (“Newsletter” or “Tedee Newsletter”) is designed to inform subscribers of the latest products, services, promotional offers, as well as educational and informational aspects and events concerning the products and services offered by Tedee.
    • The Tedee Newsletter and its content are provided for information purposes only and are not of an exhaustive or advisory nature and do not constitute an offer within the meaning of separate regulations, including the regulations of the Polish Civil Code. Tedee does not guarantee the accuracy, timeliness or completeness of the information contained in the Newsletter.
    • The material contained in the Newsletter has not been prepared with particular purposes, situations or needs of individual users in mind. The use of the information contained in the Newsletter is at the user’s own risk and the subscriber, upon acceptance of these Terms and Conditions, releases Tedee in its entirety from liability for any negative consequences arising from such use, including liability for any damages, including loss of profits, regardless of the legal basis of the claim.

  2. SUBSCRIPTION TO A NEWSLETTER SERVICE
    • The Newsletter service is available to natural persons, legal persons acting through authorised persons and organisational units without legal personality but with full legal capacity (“Subscriber”).
    • If an individual has limited legal capacity, he or she undertakes to obtain the consent of his or her legal representative to conclude the Newsletter service agreement and to present such consent upon request of the Service Provider.
    • The Service Provider does not charge Subscribers for the provision of the Newsletter service.
    • The conclusion of a contract for the provision of a digital service in the form of Tedee Newsletter is conditional on the Subscriber accepting the terms and conditions of these Terms and Conditions and indicating, in the relevant form on the website (or sub-site) www.tedee.com, the following information concerning the Subscriber:
      • email address;
      • name;
      • country;
      • preferred language of communication.
    • The contract for the provision of the Tedee Newsletter service is concluded as soon as the Subscriber receives, at the email address indicated during registration, confirmation of subscription to the Newsletter service.
    • By entering into a contract for the provision of the Tedee Newsletter service, the Subscriber agrees to:
      • the content of the Regulations, and;
      • to receive emails and other communications from Tedee relating, in particular, to the Service Provider’s products or services of a nature:
        • educational and informative (e.g. safe use of Tedee products, new product integrations, Tedee blog articles);
        • marketing and sales (e.g. product discounts, promotions, rebates, sales events), and;
        • survey-analytical (e.g. invitation to consumer research).
    • The frequency of emails and other messages within the Newsletter service shall be determined by the Service Provider.
    • The Newsletter service shall be provided for an indefinite period of time. The Subscriber may unsubscribe from the Newsletter service at any time by clicking on the “Unsubscribe” or similar link available in the footer of each email delivered by the Service Provider under the Tedee Newsletter service.
    • The Subscriber may also terminate the Newsletter service agreement by contacting the Service Provider by email at [email protected] or in writing to the Tedee contact address.

  3. OBLIGATIONS OF THE SUBSCRIBER
    • The Subscriber is obliged to:
      • to provide the Service Provider only with true, current and complete data concerning the Subscriber;
      • update without delay the data provided to the Service Provider relating to the conclusion of the Contract;
      • use the services offered by the Service Provider in accordance with applicable law and without violating the rights of third parties, in accordance with the provisions of the Terms and Conditions and the accepted customs and rules of social coexistence in this respect, in particular to avoid the provision of unlawful content  both at the conclusion of the Tedee Newsletter contract and throughout the Newsletter service
    • The Service Provider reserves the right, at its sole discretion, to suspend or cancel a Subscriber’s Tedee Newsletter subscription at any time. In addition, Tedee reserves the right to suspend or terminate a Subscriber’s subscription in the event of a breach of any provision of the Regulations, with or without notice and without further obligation to the Subscriber.
    • The Service Provider may also suspend or terminate the Newsletter service if circumstances beyond its control prevent it from providing the Newsletter service to the Subscriber.

  4. INTELLECTUAL PROPERTY OF THE SERVICE PROVIDER
    • All elements made available by the Service Provider or its partners, including works within the meaning of the Polish Copyright and Related Rights Act of 4 February 1994, are subject to the exclusive copyright of the Service Provider or the entities with which the Service Provider has concluded the relevant agreements.
    • The Subscriber may use the aforementioned contents at no cost exclusively for the proper use of the Newsletter service in his/her own personal capacity, worldwide. The use of these contents for other purposes is only permitted with the express and prior written consent of the authorised entity, under pain of invalidity.
    • Nothing contained in the Newsletter should be construed as conferring, by implication or otherwise, any right, licence or title to any Tedee and/or third party intellectual property.

  5. COMPLAINTS PROCEDURE
    • Complaints concerning the Tedee Newsletter service can be made by the Subscriber in writing to the Service Provider’s address or to the email address: [email protected].
    • At a minimum, the content of the complaint must contain the Subscriber’s name and e-mail address, the reason for the complaint and the Subscriber’s request for the manner in which the complaint is to be resolved.
    • Complaints will be processed within 14 days of receipt of the complaint by the Service Provider.
    • The Subscriber will be notified of the Service Provider’s decision in writing to the postal address or electronically to the e-mail address provided in the complaint.

  6. PROTECTION OF PERSONAL DATA
    • The Administrator of the Subscribers’ personal data is Tedee Sp. z o. o. with its registered office in Warsaw, ul. Karola Bohdanowicza 21/57, 02-127 Warsaw, Poland. Within the framework of the implementation of the Tedee Newsletter service, the Service Provider processes the following categories of personal data:
      • Subscriber’s email address;
      • Subscriber’s name;
      • country of the Subscriber;
      • the Subscriber’s preferred language of communication.
    • Subscribers have the right to contact the Data Protection Officer regarding the protection of their personal data and the exercise of their rights via the contact form at www.tedee.com, e-mail: [email protected] or in writing to the Service Provider’s registered office address indicated above.
    • Personal data will be processed for:
      • the performance of the contract for the provision of the Tedee Newsletter service (on the basis of Article 6(1)(b) GDPR);
      • fulfilment of a legal obligation incumbent on the Service Provider (on the basis of Article 6(1)(c) GDPR);
      • analytical and statistical analysis of user activities and preferences in order to improve functionality and services (based on Article 6(1)(b) GDPR);
      • marketing of own products or services, including personalised ones (based on Article 6(1)(f) GDPR);
      • the assertion or preservation of claims (on the basis of Article 6(1)(f) GDPR);
    • Subscribers’ personal data shall be processed for the duration of the Tedee Newsletter service, until the withdrawal of the granted consent or until an effective objection to the processing of the data is raised in cases where the legal basis for the processing is the Service Provider’s legitimate interest.
    • The processing period may be extended if the processing is necessary for the establishment and investigation of or defence against possible claims, and thereafter only if and to the extent required by law. At the end of the processing period, the data will be irreversibly deleted or anonymised.
    • The Subscriber has the right to access his/her personal data, to obtain a copy of them, the right to rectification, erasure, restriction of processing, the right to data portability, the right to object to data processing on the basis of the Tedee’s legitimate interest or to processing for direct marketing purposes, the right to withdraw consent at any time without affecting the lawfulness of processing (if processing is based on consent) that was carried out on the basis of consent before its withdrawal.
    • If it is considered that the processing of personal data violates the provisions of the GDPR or other data protection legislation, the data subject may lodge a complaint with the President of the Data Protection Authority.
    • A request for the exercise of data subjects’ rights may be made in writing or by email to the contact details of the Data Service Provider indicated below or directly to the Data Protection Officer.
    • The request should, as far as possible, indicate precisely what it concerns. In particular, which right the requesting person wishes to exercise and what is the subject of the request.
    • If the Service Provider is unable to determine the content of the request or identify the person making the request on the basis of the notification made, it will request additional information from the applicant.

    • Applications will be responded to within one month of receipt. If it is necessary to extend this period, the Service Provider will inform the applicant of the reasons for the extension.
    • The reply will be forwarded to the e-mail address from which the application was sent or, in the case of applications sent by post, by ordinary mail to the address indicated by the applicant, unless it is clear from the body of the letter that the applicant wishes to be contacted by e-mail (if such an e-mail address was provided).

  7. FINAL PROVISIONS
    • These Regulations are effective as of 1 January 2023 and may be supplemented or updated according to Tedee’s ongoing needs in order to provide current and accurate information to Subscribers regarding the scope of the Tedee Newsletter service, their personal data and information about them.
    • Subscribers will be informed of any changes to the privacy policy by email to the address provided for the Newsletter service.
    • If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, such provision will be deleted from the Terms and Conditions and the remaining provisions of the Terms and Conditions will remain in full force and effect.
    • No failure or delay by Tedee in exercising any right under the Regulations shall be deemed a waiver thereof, nor shall any single or partial exercise preclude any further or other exercise of that or any other right.
    • Any notices required to be delivered to the Subscriber under the Terms and Conditions may be made by email or by such other means as Tedee may specify.
